- The underlying claim in this action was an infringement claim brought by Daedalus in which it alleged that Xiaomi and Mediatek had infringed its patent by offering and selling smartphones that contained a certain type of processor made by Mediatek.
- At first instance, the Hamburg LD accepted Daedalus' application to make passages of Xiaomi's statement of defence and witness statement confidential. However, the court refused to grant access to this confidential information to Daedalus' US attorneys. It appealed this decision.
- Mediatek, having been added to the infringement action after the appeal had been filed, made the application dealt with in this decision to be joined as an intervener to the appeal in support of Xiaomi.
- The Court of Appeal granted Mediatek's application to intervene. Mediatek was held to have a "direct and present interest in the result of the appeal proceedings" as the confidential information at issue concerned information relating to Mediatek's processors. Furthermore, Mediatek only intended to participate in the appeal orally to support Xiaomi's request to dismiss the appeal and therefore would not result in any delays to the appeal proceedings.
